By reserving a yacht or making use of our Service, you consent to adhere to these Terms. If you do not accept a portion of these terms, you are not authorized to use the Service.

2. Service Overview

RiverBendPlace offers premier yacht charter services that include, but are not limited to:

  • Yacht rentals for the day
  • Evening cruises
  • Company getaways
  • Exclusive gatherings
  • Extended charters

All offered services are contingent on availability and climatic conditions. We maintain the discretion to change or cease services without prior notice.

3. Booking and Reservations

3.1 Booking Process

For charter reservations, the following is required:

  • A minimum age of 18 years
  • Provision of accurate, complete details
  • Remittance of the necessary deposit as detailed in the reservation confirmation
  • Acceptance of these Terms & Conditions

3.2 Confirmation

A confirmed booking is established upon payment receipt and our confirmation via writing. We retain the authority to decline service to any individual at our discretion.

3.3 Availability

All yacht charters depend on the availability of vessels and favorable weather conditions. Efforts to accommodate your requested dates and times will be made to the best of our ability.

4. Payment Terms

4.1 Pricing

All quoted prices are in € and inclusive of applicable taxes unless stated otherwise. Pricing is subject to modifications without prior notice.

4.2 Payment Schedule

  • Initial Deposit: 50% of the total charter cost, payable upon reservation
  • Remaining Balance: Payable within 48 hours of the charter's scheduled departure
  • Incidental Expenses (if applicable): Payable after the completion of the charter

4.3 Payment Methods

Acceptable payment methods include major credit cards, wire transfers, and certified cheques. Payments are securely processed using encrypted systems.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

  • With over 72 hours before departure: Total refund less processing fees
  • Between 24 to 72 hours before departure: 50% refund
  • Under 24 hours before departure: Non-refundable

5.2 Weather Cancellations

In scenarios where our captain assesses the weather as unsafe, we will offer either:

  • Rescheduling the charter at no extra fee on the earliest available date
  • A full refund where rescheduling is impracticable

5.3 Mechanical Issues

Should there be mechanical difficulties with the allocated vessel, efforts to supply an equivalent vessel will be made. If substitution is not feasible, a full refund will be issued.

6. Safety and Conduct

6.1 Safety Requirements

All guests must:

  • Heed all directives from the crew
  • Utilize any provided safety gear as needed
  • Communicate any health conditions that may impact their safety
  • Stay within specified areas aboard the yacht

6.2 Prohibited Items

The following are prohibited on board:

  • Containers made of glass
  • Illegal items
  • Weapons or firearms
  • Excessive beverages (beyond moderate consumption)
  • Pets (approval required in advance)

6.3 Conduct

Behavior of all passengers should be courteous and respectful. A charter can be terminated prematurely with no reimbursement if the behavior of any passenger becomes a threat to safety or disrupts the experience for others.

7. Liability and Insurance

7.1 Our Liability

Our responsibility is capped at the price paid for the charter and excludes accountability for:

  • Personal harm due to passenger negligence
  • Destruction or loss of personal belongings
  • Indirect, special, or punitive losses
  • Delays caused by weather or situations outside our control

7.2 Insurance Coverage

Comprehensive marine insurance that covers our fleet operations and vessels is maintained by us. Passengers are accountable for their travel and personal insurance arrangements.

7.3 Assumption of Risk

Engaging in our charter services indicates an acknowledgment of the innate hazards associated with waterborne activities and an assurance to take responsibility for individual safety and overall well-being.

8. Modifications and Itinerary Changes

We reserve the right to alter itineraries, routes, or schedules because of weather factors, for safety reasons, or due to operational needs. We will strive to offer suitable alternatives to the original plan.

9. Force Majeure

We cannot held responsible for delays, cancellations, or alterations brought about by factors beyond our reasonable control, which include, but are not limited to:

  • Extreme weather events
  • Natural catastrophes
  • Official regulations
  • Closure of harbors
  • Vessel malfunctions

10. Privacy and Data Protection

Your personal data is handled as per our Privacy Policy. By utilizing our services, you consent to the collection and application of your details in the manner outlined in our Privacy Policy.

11. Intellectual Property

Content on our website, such as texts, visuals, marks, and pictures, is secured by intellectual property laws. Unauthorized reproduction, distribution, or creation of derivative content is prohibited without express, documented authorization from us.

12. Governing Law

These Terms are under the jurisdiction of laws prevailing in Germany. Any conflicts will be settled in the courts domiciled in Hamburg, Germany.
